The enclosed announcement was forwarded to the Daily Press for publication. This notice relates to your application for amendment dated April 14, 2008, as supplemented by exigent amendment dated May 6, 2008. The proposed exigent amendment would allow a one-cycle revision to Surry Power Station, Unit No. 2 Technical Specifications (TSs). Specifically, TS 6.4.Q, Steam Generator (SG) Program, and TS 6.6.A.3, Steam Generator Tube Inspection Report, will be revised to incorporate an interim alternate repair criterion into the provisions for SG tube repair for use during the Surry Power Station, Unit No. 2, 2008 spring refueling outage and the subsequent operating cycle.

Please note that a notice was published in the Federal Register (73 FR 22443) on April 25, 2008 based on your original application dated April 14, 2008.

Enclosure Surry 2 Public Notice Virginia Electric and Power Company (the licensee) submitted an amendment to the Nuclear Regulatory Commission (NRC) on April 14, 2008 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML081080044) as supplemented by letter dated May 6, 2008 (ADAMS Accession No. ML081280322) for Surry Nuclear Power Station, Unit No. 2 (Surry 2). The proposed original amendment dated April 14, 2008, would allow a one-cycle revision to Surry 2 Technical Specifications (TSs). Specifically, TS 6.4.Q, Steam Generator (SG) Program, and TS 6.6.A.3, Steam Generator Tube Inspection Report, will be revised to incorporate an interim alternate repair criterion into the provisions for SG tube repair for use during the Surry 2, 2008 spring refueling outage and the subsequent operating cycle. On May 6, 2008, by supplemental letter, the licensee requested approval of the amendment based on exigent circumstances. While the original scope of the amendment submitted under the original application dated April 14, 2008, has remained the same, changed circumstances require that this amendment be expedited before the end of the 30-day comment period.

Without approval of this amendment, there will be a significant increase in the number of Surry 2 SG tubes removed from service, the SG tube margin will be reduced, and additional radiation exposure to Surry 2 personnel will be incurred to plug these tubes during the 2008 spring refueling outage.

For the original application dated April 14, 2008, an Order Imposing Procedures for Access to Sensitive Unclassified Non-Safeguards Information (SUNSI) for contention preparation and a ANotice of Consideration of Issuance of Amendment to Facility Operating License, Proposed No Significant Hazards Consideration Determination, and Opportunity for a Hearing were prepared by NRC (ADAMS Accession No. ML081060080) and published in the Federal Register (73 FR 22443) on April 25, 2008. As noted in the Federal Register Notice, the Commission may issue the license amendment prior to the expiration of the 30-day comment period should circumstances change during the comment period. Since the scope of the proposed action has not changed but exigent circumstances now exist, the Commission intends to issue this proposed amendment before the end of the original comment period. In accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Section 50.91(a)(6)i(B), the public is given an opportunity to comment on the proposed determination as published in the Federal Register Notice on April 25, 2008, however, due to time constraints, comments should be received by May 15, 2008, to be considered in making any final determination.

If the proposed determination that the requested license amendment involves no significant hazards consideration becomes final, the NRC staff will issue the amendment without first offering an opportunity for a public hearing. An opportunity for a hearing will be published in the Federal Register at a later date and any hearing request will not delay the effective date of the amendment.
