REPLY TO ENTERGY LETTER DATED FEBRUARY 8, 2008 REGARDING THE SIREN PROJECT MILESTONE SCHEDULE
Dear Mr. Balduzzi:
The purpose of this letter is to acknowledge the subject letter from Entergy, dated February 8, 2008, in which Entergy informed the NRC of its milestones for placing the new Indian Point Energy Center emergency notification system (ENS) in service. The NRC has reviewed your schedule and concluded that it provides an appropriately sequenced set of milestones for project completion and placing the new ENS in service.
The following milestones were completed on or ahead of scheduled dates: (1) your submittal of the steady and repeatable section of the design report to the Federal Emergency Management Agency (FEMA) (February 1, 2008); (2) FEMA review of that section of the report (March 7, 2008); (3) submission of the final design report to FEMA (May 8, 2008); (4) installation of new sirens not requiring permits (March 14, 2008); (5) inspection of installed sirens (April 30, 2008);
(6) permitting new sirens (April 30, 2008); and (7) far field test measurements (June 19, 2008).
You committed to place the new ENS in service eight calendar days following FEMA approval of the system for use. The subject February 8, 2008, letter states that your estimated date for placing the new siren system in service is August 14, 2008, contingent upon Entergy receiving FEMA approval for placing the new siren system in service. The NRC acknowledges that specific estimated milestone completion dates may require adjustment if actions continue to be completed in advance of the projected schedule dates.
As you committed to in your letter, Entergy will promptly inform the NRC of any potential issues that may adversely impact project completion. Further, the NRC notes that Entergy remains in noncompliance with the two previously issued Orders, dated January 31, 2006, and July 30, 2007. A final enforcement decision relative to the continuing noncompliance will be determined after Entergy places the new ENS in service.
The NRC continues to recognize that the existing ENS for Indian Point is capable of alerting the general public in the vicinity of the Indian Point station if an emergency condition occurs.
However, that system does not meet the requirements of the January 31, 2006, Confirmatory Order, because the system does not have the required backup power supply capability.
Therefore, its important that Entergy continues to provide the necessary resources to expeditiously bring this project to completion.
