Dear Mr. Filippelli:
This letter is in response to your letter dated, February 25, 2008, regarding the U.S. Nuclear Regulatory Commissions (NRC) issuance of the final Supplemental Environmental Impact Statement (SEIS) for James A. FitzPatrick Nuclear Power Plant (JAFNPP) license renewal. We appreciate your comments on the document and your staffs assistance throughout the environmental review process.
Your letter expressed concern with the NRCs use of outdated biological studies as the basis of our conclusion that impacts from impingement and entrainment are small. The NRC staff examined available relevant data to evaluate the impacts of entrainment and impingement, including data collected at JAFNPP and Nine Mile Point Nuclear Station Unit 1. The NRC staff gathered input from the New York State Department of Environmental Conservation (NYSDEC),
other governmental agencies, independent researchers, and Normandeau and Associates, Inc.
The NRC staff also examined preliminary data from the impingement and entrainment studies conducted at JAFNPP in 2005 and 2006 in support of its Clean Water Act Section 316(b)
Phase II Comprehensive Demonstration Plan. This preliminary data supported the conclusions made in the final SEISthat impacts to fish populations in Lake Ontario from impingement and entrainment at JAFNPP are small.
In the letter you also recommended that the Record of Decision for license renewal include commitments to mitigation measures expected to be required as part of the New York State Pollution Discharge Elimination System (NYSPDES) permit. The purpose of the SEIS is related to license renewal and not issuance of a NYSPDES permit. The NYSDEC is responsible for issuing and enforcing compliance with the NYSPDES permit, and the NRC has no jurisdictional authority to impose mitigation measures that may be related to the States permitting process.
As such, the NRC does not have the authority to require commitments to mitigation measures related to the NYSPDES permit in its Record of Decision related to the license renewal action.
