MILLSTONE POWER STATION, UNIT NO. 2 - WITHDRAWAL OF AN AMENDMENT REQUEST REGARDING CHARGING PUMP FLOW SURVEILLANCE REQUIREMENTS (TAC NO. MD4837)

Dear Mr. Christian:

By letter dated February 20, 2007 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML070510599), as supplemented by letter dated March 6, 2008, (ADAMS Accession No. ML080660652), you applied for an amendment to Millstone Power Station, Unit No. 2 (MPS2), Renewed Facility Operating License No. DPR-65. The proposed change would have revised the MPS2 Technical Specifications to eliminate Surveillance Requirement 4.5.2.e, which verifies charging pump flowrate. Subsequently, by letter dated April 17, 2008 (ADAMS Accession No. ML081080201), you withdrew the amendment request.

As referenced in your letter dated April 17, 2008, the Nuclear Regulatory Commission (NRC) staff identified issues regarding the license amendment request during a teleconference with Mr.

Bill Bartron of your staff on April 1, 2008. Specifically, the NRC staff has identified apparent discrepancies between the information provided in the license amendment request (LAR) dated February 20, 2007, and the facility licensing and design basis. Section 5.1 and 5.2 of the LAR state that charging pump flow is not credited for mitigation of Final Safety Analysis Report (FSAR) Chapter 14 accident analyses for MPS2. However, the NRC staff identified that Table 14.0.9-1, Overview of Plant Systems and Equipment Available for Transient and Accident Conditions, of the MPS2 FSAR credits charging pump flow to mitigate an inadvertent opening of a pressurizer pressure relief valve. Specifically, information in this Table indicates that the safety-grade charging system is credited to mitigate the MPS2 FSAR Chapter 14 accident consequences of an inadvertent opening of the pressurizer pressure relief valves.

Discussions with Mr. Bill Bartron of your staff, as noted above, confirmed that, while technical evaluations had been performed after submittal of the LAR to justify not crediting the charging pumps, the design basis calculation of record included charging pump operation to mitigate the inadvertent opening of a pressurizer relief valve event.

Based on the withdrawal of the license amendment request, TAC No. MD4837 is being closed.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

DPR-65 MILLSTONE POWER STATION, UNIT NO. 2 The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of Dominion Nuclear Conneticut, Inc., (the licensee) to withdraw its February 20, 2007, application for proposed amendment to Renewed Facility Operating License No. DPR-65 for the Millstone Power Station, Unit No. 2 (MPS2), located in New London County, Connecticut.

The proposed amendment would have revised the MPS2 Technical Specifications to eliminate Surveillance Requirement 4.5.2.e, which verifies charging pump flowrate. The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on December 4, 2007 (72 FR 68209). However, by letter dated April 17, 2008, the licensee withdrew the proposed change.

For further details with respect to this action, see the application for amendment dated February 20, 2007, as supplemented by letter dated March 6, 2008, and the licensee's letter dated April 17, 2008, which withdrew the application for a license amendment.
