REPLY-TO THE ATOMIC SAFETY AND LICENSING BOARD ORDER OF APRIL 1, 2008 AND MOTION FOR REVISION OF CERTIFICATE OF SERVICE On April 1, 2008, the Atomic Safety and Licensing Board (hereinafter "ASLB" or "Board") electronically served an Order requiring a response from the Petitioners' Westchester's Citizen's Awareness Network (WestCAN), Rockland County Conservation Association (RCCA), Public Health and Sustainable Energy (PHASE), Sierra Club - Atlantic Chapter (Sierra Club) and Assemblyman Richard Brodsky (collectively referred to as WestCAN or Petitioners). Petitioners' good faith response, upon information and belief, is contained herein.'

A. Service of WestCAN's reply WestCAN's reply was perfected by service of the original and two paper copies to the office of the Secretary of the Commission, which was deposited in the DHL courier box on February 15th. The receipt is attached as Exhibit A.

The License Renewal Proceedings for Indian Point Nuclear Generating Units 2 and 3 were docketed and commenced on August 1, 2007. The rules of service that apply are 10 CFR PART 2 Rules Of Practice For Domestic Licensing Proceedings and Issuance of Orders in affect as of August 1, 2007, as articulated under the revised 10 CFR Part 2 Rules of Practice became effective on August 28, 2007, begins with the following note: "Electronic filing and service of documents in proceedings for which notices of opportunity for hearing were published in the Federal Register or on the NRC website before October 15, 2007, are governed by the Part 2 rules in effect prior to the NRC E-Filing Rule (72 Fed. Reg. 49139 (Aug.

28, 2007)).

Subpart C Section 2.302 (a) (1) states that "documents must be filed with the Commission". On February 15, 2008, WestCAN et al, deposited a copy of their Reply brief addressed to the SECY in the Courier service box. The SECY received a hard copy of Petitioners WestCAN's Reply on February 19, 2008, which was the None of the documents contained herein were sent by Richard L. Brodsky, Esq. However, pursuantto the ASLB

first business morning after electronic filing.2 WestCAN understood that service on the Office of the Secretary, Att: Rulemaking and Adjudications Staff, was service on the on Adjudication Staff. (Exhibit A). 3 WestCAN understood that service on the SECY constituted service on the Adjudicating Staff, as the address for the SECY states the following: "Office of the Secretary, Att: Rulemaking and Adjudications Staff." The ASLB Order of February 1st confirmed WestCAN's

.understanding that service on the ASLB was accomplished by serving the SECY, as Item 4 specifically ordered that only for amending pleadings the ASLB was to be served directly.

10 CFR § 2.304(f) states "a document filed by electronic mail or facsimile transmission need not comply with the formal requirements of paragraphs (b), (c) and (d) of this section if an original and two (2) copies otherwise complying with all of the requirements of this section are mailed within two (2) days thereafter to the Secretary, U.S. Nuclear Regulatory Commission."

The ASLB Order of February 1, 2008 page 3, item 1 clearly stated "documents may be served on the Board in hard copy, on CD-ROM or as files attached to e-mail messages." (italics added). The February 1 St Order further Order of April 1, 2008, Attorney Brodsky has signed this document.

stated that a signed paper original and two paper copies...must be submitted to the Office of the Secretary." (italics added). The February 1st ASLB Order item unambiguously stated that only with regard to amending filings, MUST the ASLB be directly served. (emphasis added).

WestCAN perfected service on the ASLB, by serving the SECY as required by 10 CFR 2.304(a)-(g) and the February 1, 2008 ASLB Order. Within 2 business days of original filing WestCAN sent courtesy CD-ROM copies of the Reply via courier, on February 2 0 th, the most expeditious means available at an undue burdensome expense, to the individual members of the ASLB, one of which was in Colorado, and other individuals listed on the Certificate of Service dated March 6, 2008. (Exhibit B). CD-ROM copies for individuals with offices at the same address or Mail Stop were sent in one Fed Ex package in which individual envelopes were addressed to each individual at that location. For example the package delivered to Mail-Stop T-3-F23 at the NRC contained CD-ROM copies in separate envelopes for Lawrence G. McDade, Chair, Dr. Richard E. Wardwell, ASLB Board Panel, and Zachary S. Kahn, Law Clerk.

The CD-ROM sent by courier to the ASLB, Staff and other parties listed on the certificate of service, contained the original transmittal letter of February 15; which stated that the first transmittal, the "WORD document" should be deleted, and only the ADOBE PDF file be considered the Reply, and a transmittal letter for

February 201h of the courtesy copies. (Exhibit C). Petitioners acted in good faith demonstrated by our actions, by sending courtesy copies of CD-ROM, hardcopies by courier, and the errata of the Certificate of Service.

B. Explanation of the discrepancies in the three different Certificates of Service The Second Revised Certificate of Service dated March 6, 2008 states who was served. (Exhibit D). The difference between the preceding Certificates of Service and the March 6th Certificate of Service is that the email addresses were corrected to reflect who was actually served by email. CD-ROM's were sent to all the parties whose mailing addresses were listed.

C. Courier service, and the disposition of packages, including waybills and other documents Subpart C Section 2.302 (a) (1) states that "documents must be filed with the Commission." the staff of the Commission is considered a party."

The Secretary of the Commission (SECY) then dockets the filing, under 10 CFR § 2.303, and distributes the documents to the ASLB.

On February 15, 2008, WestCAN deposited a copy of their Reply brief addressed to the SECY in the courier service box. The SECY received a hard copy of Petitioners WestCAN's Reply on February 19, 2008, which was the first

business morning after electronic filing.4 WestCAN understood that service on the Office of the Secretary, Att: Rulemaking and Adjudications Staff, was service on the on Adjudication Staff. (Exhibit A). The ASLB order of February 1st confirmed WestCAN's understanding that service on the ASLB was accomplished by serving the SECY; item 4 specifically ordered that only for amending pleadings was the ASLB to be served directly. On February 15, 2008, WestCAN et al, deposited a copy of their Reply brief addressed to the SECY addressed to: "Att:

Rulemaking and Adjudicating Staff' in the courier service box. The SECY received a hard copy of Petitioners WestCAN's Reply on February 19, 2008-the first business morning after electronic filing. (Exhibit A & D).

D. Responses Required from WestCAN regarding Discrepant Pleadings The ASLB correctly notes the minor differences between the "WORD version" of the Reply brief sent at approximately 12:00 a.m. February 16, 2008 compared to the Adobe' Version emailed at approximately 12:53 a.m. on February 16, 2008, sent in hard copy, and burned on the CD-ROM. The differences were highlighted in exhibit F of WestCAN's response on March 21, 2008.

E. ASLB Order March 7, March 24, and April 1, 2008 4 Monday, February 18, 2008 was a federal holiday, President's Day.

On March 21, 2008, in response to the ASLB's Order of March 7, 2008, WestCAN electronically served a two part email response to all parties. A hard copy was mailed only to the Office of the Secretary and the NRC Staff Counsel on Friday, March 21, 2008, as required by 10CFR 2.304(a)-(g) and the February 1, 2008 ASLB Order. An additional exact hard copy was mailed on Monday March 24,'2008 to the ASLB Panel and to William Dennis, Esq.

Exhibits H and I and the Table of Contents were electronically submitted to all parties on March 21, 2008. There is only one table of contents, entitled "3.21.08 TABLE OF CONTENTS," thus WestCAN cannot explain or-understand why the table of contents they and other parties received did not have all the exhibits listed. Either an electronic glitch or clerical error, caused Exhibit H and I to be omitted from the received Table of Contents, even though the actual Exhibits H and I were included. Moreover, WestCAN's hard copy mailings all contained the table of contents and Exhibits H and I.

The email sent on March 21; 2008 was sent in two parts. Part two of the email contained exhibits H and I. (See responses by NYS, 4/7/08, Town of Cortlandt & Entergy (4/4/08)). Part 2 of the email was not deliverable to the following email address: Christopher.chandler(iinrc.gov, HearingDocketwnrc.gov, marc ia.Carpentier~nrc.gov, David a

Rothnrc.gov, REWanrc.gov, KDL2c)nrc.gov, Sherwin.Turk((znrc.gov, OCAAMAIL(a),nrc.gov,

Llovd.subin(nrc.gov, Beth. Mizuno-nrc.gov, Kimberly.Sexton~knrc.gov, zxk I @4ýnrc.gov, OCAAMAtL.Resource(5nc.- ov. (Exhibit B). Copies of all electronic mail sent or received by WestCAN on March 21, 2008 are annexed hereto. (See Exhibit E).

The Board correctly notes that the documents attached to Part 2 of the email are approximately 4.5 megabits. Since the NRC can receive transmission up to 12 megabits, it is not clear why Part 2 of the email was undelivered, however numerous emails to the NRC were undeliverable. (Exhibit E).

In response to a request by Zachary Kahn, from the NRC, WestCAN emailed "zip" file, which inadvertently omitted Exhibit H, on March 24, 2008.5 (Exhibit F & H). Also on March 24, 2008, WestCAN mailed a hard copy to the ASLB Panel. The "zip file" was not deliverable to William Dennis, wdennis'd,)entergy.com, and thus, a hard copy was also mailed to him on March 24, 2008.

Exhibit F is also comprised of 2 parts. Part 1 of Exhibit F, submitted March 21, 2008, was the "Adobe version" submitted by email at approximately 12:53 a.m., in hard copy, and contained on the CD-ROM. Part 2 of Exhibit F, submitted 5 Exhibit H contains the DHL receipts Petitioners' WestCAN et al. have sending their Reply Brief on February 15, 2008. These same receipts were submitted with Petitioners' Reply to Entergy's Motion to Strike as Exhibit A.

These receipts were also submitted attached to Petitioners' Response to the NRC Reply to Entergy's Motion to.

Strike as Exhibit A, At least one party did not receive the zip file; thus Petitioners' mailed courtesy hard copies to additional parties on March 24, 2008. These copies were identical to the hard copies mailed Friday, March 21, 2008.

March 21, 2008, was selected pages from the "WORD version" (exhibit A submitted on March 21, 2008). The selected pages highlighted the differences between the 12:00 a.m. and 12:53 a.m. versions. The ASLB correctly concludes that "there are no material differences between the text in Exhibit F, Part 2 and that in the 556 KB version of Exhibit F, Part 1." (ASLB Order April 1, 2008, p. 9).

On March 25, 2008, in response to the ASLB Order of March 24, 2008, WestCAN emailed and sent hard copies to parties listed on the corresponding certificate of service. The following documents were emailed as part of WestCAN's March 21, 2008 submission: (i) the table of contents, (ii) the DHL receipts submitted as Exhibit H on March 21, 2008 and March 24, 2008, (iii) the two part emails sent to all parties on March 21, 2008, and (iv) Exhibit I, an email from Sherwin Turk, Esq. on February 15; 2008, submitted as Exhibit I and on March 21, 2008 and March 24, 2008 respectively. (Exhibit E &

1). The ASLB's interpretation of these documents outlined on page 9 of the April 1, 2008 Order is correct.

However, WestCAN disagree with the ASLB's conclusion contained in footnote 29 on page 9 of the-April 1, 2008 Order. The NRC Staff was notified within two business days, on or about February 19, 2008 with the paper copy delivered by DHL and CD ROM, which included, Exhibit A, that contained the original transmittal letter of February 15th which stated that the first transmittal, the

"word document", should be deleted and only the "ADOBE PDF version" be considered the Reply of WestCAN. (Exhibit C)f6 F. Motion by WestCAN Electronic transmissions between WestCAN and the NRC have been plagued with difficulties. Last week WestCAN learned that in the middle of these proceedings the NRC has changed servers, and therefore email addresses have changed, even though old addresses are still being used in this proceeding.

WestCAN does not have an IT department, and therefore question whether the transmittal difficulties may be due to, or partially due to, the compatibility of our computer systems and the internal computer changes at the NRC.

The current Certificate of Service includes multiple individuals in the same offices at the ASLB, NRC Staff, and at Morgan, Lewis, and Bockius, as well as, individuals that are no longer part of the proceedings. This ever growing list is onerous and financially burdensome. Accordingly WestCAN respectfully makes a motion that the Certificate of Service be revised to reflect only one individual at each distinct physical address be identified to receive service, and that those individuals no longer involved in the proceedings be removed from the Certificate of Service, in order to expedite and simplify electronic transmittals.

CONCLUSION For the reasons set forth above, the ASLB should not exclude Petitioners' February 15, 2008 Reply Brief.
