Written communication as specified by 10 CFR 50.4 regarding a June 8, 2007 request to amend Facility License R-103 The University of Missouri Research Reactor (MURR) is withdrawing its request to amend Facility License R-103.
By letter dated June 8, 2007, the MURR requested a change to the facility Technical Specifications that modified the organization for the management and operation of the reactor by re-inserting the Office of the Chancellor into the administrative chain-of-command specified in Section 6.0 of the MURR Technical Specifications.
Recall that by Order EA-02-256, "Confirmatory Order Modifying License," dated December 19, 2003, the U.S. Nuclear Regulatory Commission (NRC) required that the MURR, in addition to other requirements of the Order, remove the Chancellor's Office from the administrative chain-of-command as a result of NRC and University concerns regarding potentially inadequate levels of oversight from that office. By letter dated February 5, 2004, the MURR responded to the NRC stating that the facility would comply with all conditions of the Order. Since that time, MURR has implemented all of the activities required by that Order and continues to implement self-initiated safety culture improvement efforts.
As such, MURR management felt it was appropriate to request the return of the Chancellor's Office into the chain of command for this significant University undertaking - oversight of the largest university-operated research reactor in the United States. The Office of the Chancellor is the appropriate level within the University organization to ensure that performance improvement efforts are not diluted and continue to be effective as the MURR continues to strive for excellence in its safe reactor operations and activities.
MURR recently learned from our NRC Senior Project Manager that the appropriate path for requesting this change is through the NRC's Office of Enforcement, since that is where the Order had originated.
The MURR will submit a similar request in the near future to the Office of Enforcement requesting approval to re-insert the Chancellor's Office into our administrative reporting lines for the reasons stated above.
