This letter request permission to observe the NRC inspection concerning Radiation Monitoring Instrumentation and PPE at Davis-Besse, scheduled for the week of March 3,2008.
Mr. Eric Denison of the Ohio Department of Health has been selected by the Utility Radiological Safety Board to be the designated observer. Mr. Denison has obtained unescorted access authorization; therefore, a plant escort will not be necessary. Coordination will be with Tony Go, lead Regional NRC inspector.
Enclosed is a copy of Mr. Denison's signed NRC/State Protocol Statement.

According to the NRC inspection schedule for 2008, there is an inspection scheduled for the week of March 3, 2008 at Davis-Besse concemrng Radiation Monitoring Instrumentation and PPE. In support of the Utility Radiological Safety Board, Joint Inspection Obmation Program (JIOP) activities ODH would like to send a representative to that inspection and asks that you please coordinate this request with the lead NRC inspector.
Thc person who will be obsening this inspection for ODH is Mr. Eric Denison, a Health Physicist 3 in the Technical Support Section of the Bureau of Radiation Protection.

The Regional Stab Liaison Officer (RSLD)will normally be rbe lead individual respoosible for tracking requests h r State observation,assuring consistency regarding these requests, and for advising the R e g i d Administrator 011 the dispasibons of these rcqucsts. The appropriate technical representative or Division Dircctor will communicate with the State on spccific issuer concerning thc inspecnons(s).
Requests for observations of Headqumer-bmd inspections will also be coordinated through thc RSLO.

NRC will process written requests to the Region01 Administrator through the State Liaison Officer (SLO).
Requests should identify thc type of inspection activity and facility the State wishcs to observe.
Lirmts on scope and duration of the observation pcnod may be imposed ic in (he view of the Regional Administrator, thcy cowornise the efficicncy or effectiveness of the inspection. Regions should usc their discretion as to which, if any,inspections will be excluded from observations.

State Protocol:
A State witl makc advance amangemem with the licensee for site acccss training and badghg (subject to fitness for duty requirements). prior to the actual inspection Nomally, no mora than one individual will be allowed to obscrvc an NRC inspection.
The State will be responsible fox determining the t e c h i d and prafcssional cwnpetencc of its representatives who accompany NRC inepectoss.
An obwcr's commuaicarion with the licensee will be through the appropriate NRC team mcmbcr, usually the senior rcsidcnt inspector or chc earn leader.
When informed o f an unannouncedinspection, a State mst not rclcase infmtim concerning its time and purpose.
An observer will remain in the company of NRC personnel throughout the course of the inspection.
SUR obsmration m y be terminated by the NRC if thc observer's conduct interferes with a fail and orderly inspection.
An observer will not be providedwith proprietary or safeguards information. Observers will not rcmve any material from the site without NRC or liccnsee approval.

The State observer, in accompanying the NRC inspectm, does so at his or her own risk. NRC wdl not be responsible fixinjunes or exposures to harmful substances which may occur to thc accompanying iudividual during the inspection and will assumc no liability for any incidents associated wth the accompaniment.
Thc State observer Win be cxpccted to adhere to the samc conduct as NRC inspectors during an inspechon accompaniment.
If the State obseivcr notjces any apparent non-conformance with safety ot regulatory requirements during the inspections. bdshe will make those observations momptly known to the NRC team leader OT had inspector.

Adjacent State Protocol:
An adJacmtState is a State within the plume exposure pathway emergency planning zone (WZ) (within approximately a 10-mile radius) of aa NRC-licensed facillry located in another State. A host State 1s a Stare in which ax1 NRC-licensed faciliry is located An adjacent State may request pmrnssion to observe NRC inspections at au NRC-licenscd facility in a host State.
The adjacent State SL.0 must communicate hisJher request for obsmtioa to the Regional Administrator for the region in which the facility is located.
The adjacent State SLO must also communicate hisha request to the host State SLO so that each State is a w m of thc other's intentions.
If a host Sate and an adjacent State request obscrvahon of thc same inspectidp the Regional Administrator will make thc fi-1 determination ou the Dumber of Statc observers who may attend the inspection. If then is a nced to limit tbe. numbers of obsmas, the Regional Administrator will routinely give preference to the host State observm.
