On March 17, 2008, the State of Nevada (State) and the United States Department of Energy (DOE) filed a joint motion requesting correction of purported errors in the transcript of the February 28, 2008, oral argument before the Pre-License Application Presiding Officer (PAPO)

Board. Before considering the proposed transcript corrections, we wish to ensure that the movants have verified each proposed correction with the audio video recording of the argument.

Accordingly, we have sent by overnight mail a CD of the oral argument to counsel for both the State and DOE.

The only appropriate method to resolve disputes over transcript changes is to rely upon what was actually said in the hearing room. All movants should remember that a motion for transcript corrections should be used only to seek the correction of significant and material errors in the transcription of the words that were actually spoken at an oral argument or hearing. The purpose of such a motion is not to correct misstatements, to edit the transcript, to correct grammar, to fix syntax errors, or to change minor and insignificant transcription errors.

In order to apply this general principle to the matter before us, we adopt the following procedures. The movant shall fully comply with the requirements of 10 C.F.R. § 2.323(b). We

2 will accept proposed corrections that the movant certifies involve significant spelling errors (staid / said), homonyms (light / right), capitalization of proper names, conventions for naming and numbering of documents, and transcription errors for which the correct transcription is obvious from the context (LSA / LSN). For such proposed corrections, the movant shall accompany its motion with a Transcript Errata sheet setting out the transcript page, line number, and the correction requested along with the movants certification that the proposed corrections are appropriate and conform to the provisions of this Order. For any other proposed corrections or changes, the movant shall watch and listen to the recording of the proceeding to verify that the proposed corrections were actually spoken by the identified speaker. For such proposed changes, the movant shall accompany its motion with a Transcript Errata sheet setting out the transcript page, line number, and the correction requested along with the movants certification that the movant watched and listened to the recording and the proposed substantive transcript changes are in accord with the recording of the argument. In the event of a dispute over a proposed correction, the movant should identify fully the disagreement.

Any amended motion, new transcript errata sheets, and certifications shall be filed by April 7, 2008.
