Dear Mr. Anderson:

I am responding to your letter requesting a 90-day extension in the public comment period for the Decommissioning Planning rulemaking (RIN 3150-AH45). After due consideration of your request and considering the staffs previous efforts at public outreach during this rulemaking, the Commission is extending the public comment period for the Decommissioning Planning rulemaking by 30 days. A notice extending the public comment period is being sent to the Office of the Federal Register today (enclosed).

The staff has aggressively encouraged public comments on this rulemaking, and has contacted approximately 60 stakeholders by telephone and e-mail to inform them of the proposed rule publication in the Federal Register on January 22, 2008 (73 FR 3812). The staff has received telephone calls from stakeholders with questions about the rulemaking process and submittal of public comments. Interest in this rulemaking includes environmental advocacy groups (e.g.

Riverkeeper and Three Mile Island Alert), law firms representing licensees, trade groups representing materials licensees, Agreement States, and licensees. The technical basis issues in the proposed rule, draft rule text and recommended guidance published on January 22, 2008, for public comment are being addressed by all affected stakeholders. Upon signature of this letter to you extending the comment period by 30 days, the staff is contacting the 60 stakeholders again by telephone and e-mail to inform them of this extension in the comment period.
