Dear Mr. Marion:
On December 21, 2007, you provided the Nuclear Regulatory Commission (NRC) a copy of draft revision 2 of NEI 00-01, Guidance for Post-Fire Safe-Shutdown Circuit Analysis, for the NRC staffs review (Agencywide Document Management and Access System (ADAMS)
Accession No. ML080310056). In the cover letter you discuss the regulatory justification for the application of NEI 00-01. In addition, you provided the NRC a more comprehensive list of Multiple Spurious Operations to review on March 26, 2008 (ML080860168).
As you know, the NRC staff is pursuing a regulatory closure path to this issue. We shared details of this closure path with NEI during a March 27, 2008, public meeting here at NRC headquarters (ML081060550). On May 7, 2008, we held a second meeting and obtained additional feedback from the public and industry stakeholders on the proposed closure path.
Based on the feedback from the May 7, 2008, meeting, we understand that the approach in the submitted document has changed due to your plans to incorporate the NRCs closure path into draft NEI 00-01, Revision 2. Therefore, we do not plan a full review of this document at this time.
However, my staff plans to continue to work with your staff regarding some of the technical details of the method discussed in draft NEI 00-01, Revision 2.
