OF FEBRUARY 28, 2008, CONFERENCE CALL BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION, DIVISION OF LICENSE RENEWAL ENVIRONMENTAL STAFF AND NATIONAL MARINE FISHERIES COMMISSION REGARDING INTER-AGENCY CONSULTATION UNDER SECTION 7 OF THE ENDANGERED SPECIES ACT The Division of License Renewal staff (NRC staff) conducted a conference call with Ms. Julie Crocker of the National Marine Fisheries Service Northeast Regional Office (NMFS) to discuss the NRCs consultation with NMFS under Section 7 of the Endangered Species Act (ESA) pertaining to the shortnose sturgeon, an endangered species present in the Hudson River near Indian Point, Units 2 and 3. The ESA requires that federal agencies consult with NMFS when endangered marine species may be affected by a federal action. NRC staff also discussed with Ms. Crocker historic impingement of shortnose sturgeon at Indian Point, Units 2 and 3.

Ms. Crocker indicated that NMFS is currently reviewing Atlantic sturgeon for listing under the ESA as threatened or endangered, but NMFS had not yet determined whether to list the species. Ms. Crocker indicated that it is not necessary at this time for NRC staff to address license renewals potential impacts on the Atlantic sturgeon in a biological assessment (BA) for ESA consultation unless NMFS lists the species. Ms. Crocker suggested that the NRC staff discuss potential effects on the Atlantic sturgeon in the text of the Indian Point Draft Supplemental Environmental Impact Statement. Should the Atlantic sturgeon be listed under the ESA prior to the completion of the Indian Point license renewal review, the NRC staff may need to amend the BA or take other action to address potential impacts of license renewal on the Atlantic sturgeon.

Finally, Ms. Crocker confirmed that current consultation and consultation for any future incidental takes at Indian Point, Units 2 and 3 should take place under Section 7 provisions of the ESA. Facilities without Federal oversight must interact with NMFS through Section 10.
