February 26, 2008 EN 08-013 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Luminant Generation Company, LLC EA-08-028 Comanche Peak Steam Electric Station, Unit 1 Docket No. 05000445

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process (SDP) finding will be issued on or around February 29, 2008, to Luminant Generation Company, LLC as a result of a special inspection at the Comanche Peak Steam Electric Station. This White finding, an issue with low to moderate importance to safety, which may require additional NRC inspections, involves a Diesel Generator (DG) that was found to have been inoperable for about 20 days, in violation of licensee Technical Specifications. The inoperability was caused by paint being inadvertently deposited onto at least one fuel rack location that prevented the fuel rack from moving from the closed to open position, and thus preventing sufficient fuel from reaching the engine. The inspectors confirmed the licensees conclusion that, during painting activities on and around the DG, the painters and others who were charged with performing daily paint clean-up inspections failed to identify spatter and drops that needed to be cleaned off of sensitive engine components.

A Notice of Violation is included based on the failure to meet Technical Specifications 3.8.1 which requires that two DGs be operable and for the condition when one DG is inoperable, to take actions to restore the DG or be in Mode 3 and Mode 5 within specified time frames. In accordance with the NRC Enforcement Policy, the Notice of Violation is considered an escalated enforcement action because it is associated with a White finding.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
