Dear Mr. Pollock:
The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.
1-2007-014) on December 19, 2006, to determine if an administrative clerk stationed at Indian Point was discriminated against for engaging in protected activity. Based on the evidence developed during the investigation, OI concluded there was insufficient evidence to substantiate that the individual was discriminated against.
OI determined that the individual engaged in protected activity for writing condition reports (CRs). However, based on documentary and testimonial evidence, OI found that those actions the administrative clerk believed to be adverse were not, and those actions that were considered reprimands were related to actual performance problems. In no case did OI find evidence that the perceived adverse actions experienced by the individual resulted directly from having written CRs.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
