SUMMARY

OF THE JANUARY 9, 2008, MEETING WITH NUCLEAR MANAGEMENT COMPANY TO DISCUSS THE PROPOSED COMBINED EMERGENCY PLAN (TAC NOS. MD6294, MD6295, AND MD6296)

On January 9, 2008, the Nuclear Regulatory Commission (NRC) staff held a Category 1 public meeting with representatives of Nuclear Management Company (NMC) at NRC offices located at 11555 Rockville Pike, Rockville, Maryland. The licensee requested this meeting to discuss with the NRC staff the appropriate, efficient, and timely licensing process within the existing regulatory framework for review and approval of the proposed combined emergency plan (see NMC letter to the NRC, dated August 7, 2007; Agencywide Document Access and Management System (ADAMS) Accession No. ML072200142). A list of attendees is provided as Enclosure 1.

The licensee=s handout material has been docketed and is publicly available at ADAMS Accession No. ML080090524. Licensee personnel followed the handout in their presentation of the issues.

After a caucus, the NRC staff informed NMC that it will review NMCs August 7, 2007, submittal as one that involves a decrease in effectiveness. A provision of 10 CFR 50.54(q) states, in part, [p]roposed changes that decrease the effectiveness of the approved emergency plans may not be implemented without application to and approval by the Commission. Accordingly, the NRC staff will issue a Request for Additional Information when it can specifically identify its need for additional information. The NRC staff indicated that a review of this type cannot be accommodated within the schedule (i.e., complete by August 7, 2008) proposed by NMC. NMC personnel indicated, without giving specifics, that the NRC review can go beyond August 7, 2008, without a significant impact on the activities for Monticello and Prairie Island.

The NRC staff and NMC personnel agreed to work closely to develop the review schedule, and to hold additional future meetings as the need arises to discuss specific issues.
