NRC Office of Investigation (OI) Case 1-2007-013
Dear Mr. Pollock:
The Region I Field Office, NRC Office of Investigations (OI) initiated an investigation (Case No.
1-2007-013) on December 18, 2006, to determine if an instrumentation and controls (I&C) technician at Indian Point was discriminated against for having raised a safety concern.
Specifically, the I&C technician was sent home from work by supervision on August 9, 2006, after refusing to perform a surveillance activity that the technician believed he/she was not qualified to perform.
Based on the evidence developed during the investigation, OI did not substantiate that Indian Point management discriminated against the technician. Testimonial evidence revealed that the technician was not qualified to perform the surveillance activity. However, OI determined that both the technicians supervisor and a co-worker involved in this incident informed the technician that the surveillance activity could be performed in accordance with procedures, as long as he/she was accompanied by the co-worker, who was qualified to perform the surveillance activity. Testimonial and documentary evidence gathered by OI further revealed that the technician was not sent home for having raised a safety concern, but because of a legitimate business reason.
