Dear Mr. Bunt:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your October 31, 2007, letter requesting a fee waiver under 10 CFR 170.11(a)(1)(iii) for all fees associated with NRCs review of BWROG Licensing Topical Report (BWROG-07055). I am granting your request for a fee waiver, as explained below.
Your fee waiver request states that BWROGs report to be submitted in December 2007 will be a means of exchanging information between industry organizations and the NRC for the specific purpose of supporting the NRCs generic regulatory improvements or efforts. Although the topical report has not yet been submitted, the NRC staff has received sufficient preliminary material, including presentation materials from a series of meetings that allows the NRC to make a decision on a fee waiver prior to receipt of the report.
Based on the material presented during the meetings and draft information reviewed, the NRC staff has concluded that this BWROG report will provide a means of exchanging information to support NRCs generic regulatory improvements or efforts. The NRC staff will be using the topical report (once reviewed and approved) for the specific purpose of supporting development of a revision to Regulatory Guide 1.82, "Water Sources for Long-Term Recirculation Cooling Following a Loss-of-Coolant Accident." Therefore, the review of the BWROG-07055 meets the provisions of 10 CFR 170.11. Hence, I am able to grant you a fee waiver under the provisions of 10 CFR 170.11(a)(1)(iii).
