Dear Mr. Lickus:
This letter requests permission to observe the NRC inspection concerning Radioactive Gaseous and Liquid Effluent Treatment and Monitoring Systems at Perry Nuclear Power Plant scheduled for the week of December 10-14,2007. Mr. Robert Leidy of the Ohio Department of Health has been selected by the Utility Radiological Safety Board to be the designated observer.
Coordination will be made with the NRC Inspector, Marty Phalen. Mr. Leidy has not obtained unescorted access authorization; therefore, a plant escort will be necessary.
Enclosed is a copy of Mr. Leidy's signed NRC/State Protocol Statement.

November 19,2007 Mrs. Carol O'Claire Branch Chief Ohio Emergency Management Agency 2855 W Dublin-Granvillc Road Columbus, Ohio 43235 Re: Pcrry Nuclear Power Plant (F'NPP) and Davis-Resse Nuclear Power Station (DBNPS) Inspections Dcar Carol, According to the NRC inspection schedule for 2007, there are inspections scheduled for the week of December 10-14,2007 at PNPP and DBNPS concerning Radioactive Gaseous and Liquid Effluent Treatment and Monitoring Systems and Radioactive Material Processing and Transportation. ODH would like to send a representative to observe each of those inspections and asks that you please coordinatc this request with the lead NRC inspectors.
The person who will be observing the inspection at DBNPS i s Ms. Terry McCall, a Health Physicist 3; at PNPP the inspection will be observed by Mr. Robert Leidy also a Health Physicist 3.

PAGE 6 3 / 8 5 The Regional State Liaison Officer (RSLO) will normally be the lead individual responsible for tracking requests for State observation. assuring consistcncy regarding these requests, and for advising the Regional Administrator on the dispositions of thcse requests. The appropriate technical representative or Division Director will cornmunicatc with the Statc on specific issues concerning the inspections(s).
Rcquests for observations of Headquarter-based inspections will also be coordinatcd through thc RSLO.
Headquarters-based inspections should be referrcd through thc RSLO to a technical reprcsentative designated by the Region.
NRC will process mittm requests to thc Regional Administrator through the State Liaison Officer (SLO).
Requests should identify tho type of inspection nctivity and facility the Statc wishes to observe.
Limits on scope and duration oftbe observation period may be imposed if-in thc view of the Regional Administrator, they compromise the efficiency or effectiveness of thc inspection. Rcgions should usc their discrefion as to which. if any, inspections will be excluded from observations.
State will be informed they must nor release infonnacion concerning the rime and purposc of unannounced inspections.
The Region will make it clear to the licensee that the Statc vicws are not necrsrarily endorsed by NRC. The Region will also make it clear that only NRC has regularory authoriryfor inspection findings and.enforuemmt actions regarding radiological health and safcry.
A State will make advancc arrangements with the licensec for sire access training and badging (subject to fitness for duty requirements), prior to rhe actual inspection.
Normally? no more than one individual will be allowed to observe an NRC inspecrion.
The State will be responsible for dctcrmining the technical and professional comperencc of its representatives who accompany NRC inspecton.
An obscrvet's communication with the licensee will be through the appropriate NRC team member, usually thc srnior resident inspector or the team leader.
when informed of an unannounced inspection, a State must not release information conccrning its time and purpose.
An observer will remain in the company ofNRC personnel throughout thc coursc of fhc inspection.
Sfate observation may be terminated by the NRC if the observer's conduct interferes with a fair and orderly inspection.
An obscrvcr will not be provided with proprietary or safeguards information. Obscrvms will not remove any material from the site without NRC or licensee approval.
