RESPONSE TO CONFIRMATORY ACTION LETTER NOTIFICATION

Letter from Joseph P. Grimes (Exelon Nuclear) to Samuel J. Collins (U.S.
Nuclear Regulatory Commission) dated October 25, 2007 (ML073040516)
Dear Mr. Grimes:
In accordance with NRC Confirmatory Letter (CAL), No. 1-07-005 (ML0729202837), Exelon committed to conducting and documenting daily random observations of security at Peach Bottom Atomic Power Station (PBAPS) until November 18, 2007. In the referenced letter, Exelon notified the NRC that observations by corporate security management at Peach Bottom were not conducted on October 20, 2007 and that the issue had been entered into your corrective action process. The five (5) observations were completed by site security management, but none were completed by corporate management as stated in the CAL. Your corrective actions included establishing a point of contact to verify that subsequent daily observations were being performed, and making daily affirmations to the point of contact to ensure the observations were completed. We also acknowledge that no additional observations were missed prior to the conclusion of this commitment on November 18, 2007.
While the NRC has reviewed Exelons corrective actions in response to this specific aspect of the CAL and has found them to be acceptable, the NRCs reviews and actions regarding the inattentive security officers at Peach Bottom are ongoing. In addition, the NRC issued a reactor oversight process (ROP) deviation memorandum (ML073320344) on November 28, 2007, to provide increased oversight of the PBAPS and activities of the licensee, Exelon Generation Company, LLC. In accordance with the deviation memorandum, this issue will be the subject of future inspection.
