NRC RECEIPT OF INDIAN POINT NUCLEAR GENERATING UNIT NOS. 2 AND 3 RESPONSE TO GENERIC LETTER 2006-03, POTENTIALLY NONCONFORMING HEMYC AND MT FIRE BARRIER CONFIGURATIONS (TAC NOS. MD1589 AND MD1590)
Dear Mr. Balduzzi:
The Nuclear Regulatory Commission (NRC) acknowledges the receipt of your response, dated June 8, 2006 (Agencywide Documents Access and Management System (ADAMS) accession number ML061720091), to Generic Letter (GL) 2006-03, Potentially Nonconforming Hemyc and MT Fire Barrier Configurations, and your supplement dated November 28, 2007 (ADAMS Accession No. ML073390309). Under oath or affirmation, you stated that Indian Point Nuclear Generating Unit Nos. 2 and 3 rely on either the Hemyc or MT fire barrier system to separate redundant safe shutdown trains located within the same fire area. You have also submitted documentation to indicate that nonconforming conditions have been evaluated and approved by the NRC. The basis for stating that these fire barriers have been approved by the NRC should be maintained on site, and will be subject to inspection during the normal NRC inspection process.
The NRC staff finds that you have properly addressed the concerns with the Hemyc and MT fire barrier systems, and finds your response to GL 2006-03 to be satisfactory.
