REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR KEWAUNEE POWER STATION, MILLSTONE POWER STATION, UNITS 2 AND 3, NORTH ANNA POWER STATION, UNIT NOS. 1 AND 2, AND SURRY POWER STATION, UNIT NOS. 1 AND 2 (TACS. MD6144, MD6145, MD6146, MD6147, MD6148, MD6149 AND MD6150)

By letter dated November 9, 2007, and affidavit dated October 2, 2007, executed by David H.

Peace of Swagelok Company, Dominion Energy Kewaunee, Inc. (the licensee), Dominion Nuclear Connecticut, Inc. (the licensee), and Virginia Electric and Power Company (the licensee), submitted responses for Nuclear Regulatory Commission (NRC) staffs request for additional information with respect to licensees original application submitted on July 25, 2007, requesting NRC approval to use the alternative rules of American Society of Mechanical Engineers (ASME), Boiler and Pressure Vessel Code (Code),Section III, Division 1, Code Cases N-756 and N-757 for Kewaunee Power Station, Millstone Power Station, Units 2 and 3, North Anna Power Station, Unit Nos. 1 and 2, and Surry Power Station, Unit Nos. 1 and 2. The licensee requested that Swagelok proprietary document, Design Report, ASME BP&V Section III, Class 3, SS-45S8-18622-NSR Ball Valve, SS-45XS8-18623-NSR Ball Valve, (Enclosure 1 of to your letter) be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390.

A nonproprietary copy of this document, Enclosure 2 of Attachment 1 to your letter dated November 9, 2007, Design Report, ASME BP&V Section III, Class 3, SS-45S8-18622-NSR Ball Valve, SS-45XS8-18623-NSR Ball Valve, has been placed in the NRC's Public Document Room and added to the Agencywide Documents Access and Management System Public Electronic Reading Room.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

(a)

This information is being held in confidence by Swagelok.

(b)

This information is of a type that is held in confidence by Swagelok, and there is a rational basis for doing so because the information contains sensitive commercial information concerning manufacturing of Swagelok valve components.

(c)

This information is being transmitted to the NRC in confidence.

This information is not available in public sources and could not be gathered readily from other publicly available information.

(e)

Public disclosure of this information would create substantial harm to the competitive position of Swagelok by disclosing confidential Swagelok manufacturing information to other parties whose commercial interests may be adverse to those of Swagelok. Furthermore, Swagelok has expanded significant engineering resources in the development of the information. Therefore, the use of this confidential information by competitors would permit them to use the information developed by Swagelok without the expenditure of similar resources, thus giving them a competitive advantage.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the versions of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
