In a letter dated November 7, 2007, that was addressed to both the Nuclear Regulatory Commission (Commission) and the Atomic Safety and Licensing Board Panel (ASLBP), Friends United for Sustainable Energy (FUSE) requested an extension of time in which to file their formal Request for Hearing and Petition to Intervene. In the body of this letter, however, this request is directed only to the Commission and not to the ASLBP. See FUSE Letter of Nov. 7 at 1, 10.
Since this request was addressed directly to the Commission, this Board, as the subordinate tribunal, will defer consideration of this request pending action on it by the Commission.
It is so ORDERED.
