Dear Congressman Garrett:

This letter is in response to your October 31, 2007, letter to Chairman Dale Klein of the U.S.

Nuclear Regulatory Commission (NRC), regarding the Indian Point Nuclear Generating Unit Nos. 2 and 3 (Indian Point) license renewal application (LRA). Specifically, you requested that the NRC, in preparing its environmental impact statement (EIS) for the Indian Point LRA, carefully consider the recommendations of the Environmental Protection Agency (EPA) to include an assessment of terrorism readiness.

By letter dated October 10, 2007, the NRC staff received scoping comments from EPA Region 2 regarding the Indian Point LRA environmental review. In addition to these comments, the NRC has received numerous comments from various other persons and organizations. As part of the license renewal environmental review process, the NRC staff will consider your comments and other comments received during the scoping process, as appropriate, in accordance with applicable legal requirements.

With respect to your request for information concerning the NRC staffs environmental review for the Indian Point LRA, the staff is preparing a Scoping Summary Report, which will summarize the comments received during the scoping process. Thereafter, the staff will prepare and publish a site-specific Draft Supplement to the Generic Environmental Impact Statement for license renewal, in accordance with 10 CFR Part 51. The staff expects to issue the Draft Supplement for public comment in mid-2008, and will publish a notice in the Federal Register announcing its availability. The Final EIS is scheduled to be issued in 2009, following the staffs consideration of any comments on the Draft Supplement. The staff will publish a notice in the Federal Register announcing the availability of the Final EIS.
