Dear Mr. Martinelli:

In an email addressed to the Chairman of the Nuclear Regulatory Commission (NRC) dated September 21, 2007, you asked that your email be treated as a formal petition pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Section 2.206. By letter dated October 24, 2007, the NRC informed you that your email did not meet the criteria for a 10 CFR 2.206 petition, but committed to send you a written response.

In regards to your statements about electronic access to historical licensing documents that are held by the NRC, those documents that are available to members of the public can be accessed through the Agencywide Documents Access and Management System (ADAMS). ADAMS is an information system that provides electronic access to all image and text documents that the NRC has made public since November 1, 1999. In addition, the ADAMS Legacy Library contains bibliographic information such as title, date, author, and docket number on records that the NRC made public before November 1999. The ADAMS system can be reached through the NRC website, http://www.nrc.gov by selecting electronic reading room, and then selecting ADAMS documents.

Some older documents have been scanned into the ADAMS Main Library, but most of the documents dated prior to November 1, 1999, are stored on microfiche. The bibliographic information of these older documents can be searched using the Legacy Library, which is only available in the Citrix-based version of ADAMS, which can be accessed from the NRCs web site. The public can obtain copies of the older publicly available documents through the NRCs Public Document Room (PDR). The PDR can be contacted by email at pdr@nrc.gov, by calling 1-800-397-4209 or 301-415-4737, or by visiting the PDR in person at 11555 Rockville Pike, Rockville, MD 20852. There is a nominal fee for retrieving pages from microfiche.

There is no Federal requirement for the NRC to make older documents available electronically in ADAMS. Under the Freedom of Information Act (FOIA), you may submit a request for documents you are interested in, including proprietary documents, and the NRC will review and respond to your request. FOIA requests may be made on the NRC website.

S. Martinelli Your contention that the NRC has almost fully redacted Chapter 14 of the Indian Point Updated Final Safety Analysis Reports (UFSARs) is incorrect. The redacted version of the UFSARs, which are publicly available, have had nothing redacted from Chapter 14 for either unit. The NRC redacted only 39 pages out of more than 3500 pages. The redacted pages are listed in the front matter for each units UFSAR. Also, you asked about the General Design Criteria (GDC) for the Indian Point units. The GDC are stated in each UFSAR.

In regards to your comments on the license renewal process for Indian Point, the NRC is accepting hearing requests on the license renewal application until November 30, 2007. Please submit your hearing requests as stated in the Federal Register notice at 72FR55834.
