Dear Sir or Madam:
On January 3, 2007, the Nuclear Regulatory Commission (NRC) issued a Confirmatory Order to Nuclear Management Company, LLC (NMC), the former licensee for the Palisades Nuclear Plant (PNP). The Confirmatory Order was part of a settlement agreement between NMC and the NRC, dated August 22,2006, regarding an apparent violation of 10 CFR 50.7, "Employee protection." The terms and conditions of the settlement agreement are set forth in Section IV of the Confirmatory Order.
Entergy Nuclear Operations, Inc. (ENO) has completed the actions at PNP, as stated in section IV of the Confirmatory Order. The completed actions are summarized below.
The policies for writing corrective action program (CAP) reports were reviewed, revised and communicated to all employees. Training was provided to all employees to clarify the expectations regarding the use of the CAP, and to ensure employees are neither discouraged from using the CAP, nor retaliated against, or perceived to be retaliated against, for using the CAP.
The safety culture policy, including safety conscious work environment (SCWE), was communicated to employees during all-employee meetings. The sessions provided question and answer opportunities.
Training was provided to supervisors and above who had not received credit for a SCWE class within the two years preceding the Confirmatory Order. The class material was presented by a qualified instructor.
Training programs have been established to ensure refresher SCWE training is provided to employees.
Document Control Desk Page 2 A policy has been implemented to ensure adverse employment actions are in compliance with the NRC employee protection regulations.
EN0 will continue to implement a process that ensures that adverse employment actions are in compliance with NRC employee protection regulations and principles of SCWE.
