Dear Ms. Banovac,

SUBJECT:

Meeting Request Dairyland Power Cooperative (DPC) respectfully requests a meeting with the appropriate NRC staff to discuss upcoming plans for dry cask storage at the La Crosse Boiling Water Reactor (LACBWR). DPC will also update the staff on the completion of the Reactor Pressure Vessel Removal project and future preliminary plans for decommissioning.

DPC requests a portion of the meeting to be closed to the public in order to provide information to the staff that is considered proprietary. The specific proprietary topics include reactor building modifications and cask operations strategy. These topics require DPC to show conceptual drawings of modifications containing unverified information and locations of key plant components. In addition, DPC plans to discuss cask system procurement status, which is privileged and confidential commercial information.

This information is not available from public sources. DPC requests the information to be presented during this portion of the meeting between the NRC staff and DPC be withheld from public disclosure.

This letter and attached preliminary agenda and affidavit do not contain proprietary information.

Select information and slides presented by Dairyland Power Cooperative (DPC) and its contractors to the U.S. Nuclear Regulatory Commission (NRC) during the requested meeting to discuss the La Crosse Boiling Water Reactor's (LACBWR) dry cask storage plans.

(B) Official position of the person making the affidavit:

Pursuant to 10 CFR 2.390 (a) (4), the information proposed to be withheld contains commercial information and is privileged and confidential information held in confidence by DPC; The information is of the type described in Regulatory Issue Summary (RIS) 2005-31 , Screening Criteria for Security-Related Sensitive Unclassified Non-Safeguards Information.

The information will be presented to the NRC Staff by DPC and its contractors in confidence; The information is not available in public sources.

(D) Specific statement of the harm that would result if the information is disclosed to the public:

The slides to be presented and discussed include information the NRC has recommended not be disclosed to the public in RIS 2005-31 regarding security related sensitive unclassified non-safeguards information. Thus DPC controls the information as proprietary and not to be disclosed to the public; The cask system procurement process includes a closed bid evaluation that is confidential and proprietary. Due to the highly competitive nature of the cask system supply market and the fact that DPC will not have announced the selected vendor at the time of the meeting, public access to such information would compromise the procurement process.

DPC is providing a preliminary agenda to delineate the topics and parts of the meeting to be withheld from public disclosure.
