NRC STAFF ANSWER TO NEC MOTION TO FILE A TIMELY NEW OR AMENDED CONTENTION Pursuant to 10 C.F.R. §§ 2.309(h)(1) and 2.323(c), the Staff of the Nuclear Regulatory Commission (Staff) herein answers New England Coalition, Inc.s (NEC) Motion to File a Timely New of Amended Contention dated September 4, 2007 (Sept. 4 Motion). The contention in NECs Sept. 4 Motion is identical to its July 12 Contention except it is based on Entergys final fatigue calculations, which were disclosed on August 2, 2007. For the reasons set forth in NRC Staff Answer to NEC Motion to File a Timely New or Amended Contention (Aug. 6, 2007), the Staff does not object to admission of NECs proposed contention.
