Dear Mr. Middlesworth:
This letter refers to an investigation conducted by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI) to determine whether an unlicensed operator at Duane Arnold Energy Center had willfully failed to notify his supervisor of an arrest and whether he willfully failed to list his arrest on a Personal History Questionnaire during a subsequent background investigation. Based on the evidence developed during the investigation, we did not substantiate the allegation. The synopsis from the OI report of investigation is enclosed.

Case No. 3-2007-017 Enclosure SYNOPSIS This investigation was initiated on May 3, 2007, by the U.S. Nuclear Regulatory Commission, Office of Investigations, Region III, to determine whether an unlicensed operator at Duane Arnold Energy Center had willfully failed to notify his supervisor of an arrest and whether he willfully failed to list his arrest on a Personal History Questionnaire during a subsequent background investigation.
Based upon the evidence developed, this investigation did not substantiate the allegation that an unlicensed operator at Duane Arnold Energy Center had willfully failed to notify his supervisor of an arrest. This investigation also did not substantiate the allegation that an unlicensed operator willfully failed to list his arrest on a Personal History Questionnaire during a subsequent background investigation.
