Dear Mr. Bronson:
On November 27, 2006, the Region I Field Office, NRC Office of Investigations (OI), initiated an investigation to determine if a project manager with Entergy's Corporate Security Organization was discriminated against for having engaged in prior protected activity. Specifically, the alleged discrimination involved receiving less than average merit system raises after engaging in a protected activity at Pilgrim in 2002.
Based on the evidence developed during the investigation, OI was unable to substantiate that the project manager was discriminated against at Pilgrim for having engaged in protected activity in 2002. OI noted clear evidence that the project manager engaged in a protected activity in 2002. However, testimony revealed that the project manager's supervisors, who were responsible for determining the appropriate level of merit raises, were not aware of the project manager's protected activity nor were they influenced by anyone in awarding the merit raises to the project manager. OI also noted that there were no guidelines for merit awards, and that the supervisors had discretion to determine the amount using common factors such as level of responsibility, individual salary range and performance.
