MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN -

R. E. GINNA NUCLEAR POWER PLANT

Dear Mr. Carlin:

On August 14, 2007, the NRC staff completed its performance review of R. E. Ginna Nuclear Power Plant (Ginna) for the first half of the calendar year 2007 assessment cycle. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results over the previous twelve months. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include security information. A separate letter designated and marked as Official Use Only-Security Information will include the security cornerstone review and resultant inspection plan.

Plant performance for the most recent quarter was within the Licensee Response column of the NRCs Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green). However, Ginna was within the Degraded Cornerstone column for the 1st quarter of 2007 due to one Yellow Emergency Preparedness PI. Specifically, the Emergency Response Organization (ERO) Drill Participation PI crossed the Yellow threshold during the 1st quarter 2007, when Ginna staff realized that control room communicators, a key ERO position, did not receive the required drill or exercise opportunity after qualification. Following the identification of this issue, Ginna staff reexamined previous PI data and determined that the 4th quarter 2006 ERO PI had crossed the White threshold and therefore, Ginna had entered the Regulatory Response column in the 4th quarter 2006. The ERO PI rating was reported Green for 2nd quarter 2007.

Your staff has informed the NRC that you will be ready on November 25, 2007, for the NRC to review your actions taken to address the Yellow Emergency Preparedness PI. Therefore, we plan to conduct supplemental inspection 95002 beginning on November 26, 2007. This inspection is conducted to provide assurance that the root and contributing causes for the risk significant performance issues are understood, to independently assess the extent of condition, to independently determine if safety culture components contributed to the performance issues, and to provide assurance that the corrective actions are sufficient to prevent recurrence.

In addition to baseline inspections and the supplemental inspection, we plan on conducting a containment sump modification and license renewal commitments inspections. The enclosed

J. Carlin 2 inspection plan details the inspections, less those related to physical protection, scheduled through December 31, 2008. The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite.

Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plan are tentative and may be revised at the end-of-cycle review.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

The NRC is currently evaluating the scope and frequency of all baseline inspection procedures.
