Dear Ms. Shapiro:
I am responding to your letter dated June 27, 2007, regarding the license renewal application (LRA) for Indian Point Nuclear Generating Unit Nos. 2 and 3, submitted by Entergy Nuclear Operations, Inc. on April 23, 2007. In your letter, you provided a list of Complaints/Contentions/Allegations Regarding Indian Points Current Flawed and Failing Operation, and requested that ALL the above iterated and all other problems that affect the safe operation of IP MUST BE fully investigated and repaired in order to maintain intended function, and bring Indian Point into FULL COMPLIANCE with the 10 CFR [Title 10 of the Code of Federal Regulations] rules and regulations, as well as its original DB [design basis] prior to the NRC accepting the licensee's license renewal application, or being granted a new superceding license.
By letter dated July 25, 2007, the NRC staff accepted the LRA for Indian Point Nuclear Generating Unit Nos. 2 and 3 for docketing and review. This acceptance does not constitute a determination that a renewed license should be issued, and does not preclude the staff from submitting such requests for additional information as the staff may determine are appropriate or necessary, as its review proceeds. As stated in the notice of acceptance for docketing and opportunity for hearing published in the Federal Register on August 1, 2007 (72 FR 42134), any contention filed as part of a request for a hearing or petitions for leave to intervene, with respect to license renewal, must be filed in accordance with the Commissions Rules of Practice for Domestic Licensing Proceedings in 10 CFR Part 2.
With respect to the complaints brought forth in your letter, the NRC staff will further consider these issues, to the extent that they are relevant to license renewal, during the course of its review of the LRA. In addition, any concern brought forth in your letter that may affect current safe operation of the plant has been, or will be, considered in the appropriate process pertaining to the current operating license.
