Dear Mr. Epstein:

Thank you for your recent submission concerning PPL Susquehanna, LLC's (PPL's) application to modify its surface water withdrawal and consumptive use approvals from the Susquehanna River Basin Commission (Commission). Your submission contains two essential parts: (1) a "Petition in Opposition" setting forth six "contentions" or issues of concern related to the application referenced above; and (2) a formal request to convene a public hearing on the matter.

With respect to the petition, please note that we are treating it as public comment being submitted for consideration in our review of the subject application. As such, it is now part of the record and we will distribute it to our commissioners for their review'and consideration in advance of any action on the application. We appreciate your interest in the application and will give your comments due consideration. If you would like to meet with Commission staff to discuss your comments in greater detail, please contact us to make suitable arrangements.

With respect to your request for a public hearing, we anticipate that the application will be reviewed and acted upon by the Commission at a public hearing to be convened as part of the Commission's regularly scheduled business meeting at the Grand Royale Hotel, 80 State Street, Binghamton, New York, on September 12, 2007, beginning at 8:30 a.m. In addition to responding to your submission, this letter also serves as notice to you of that public hearing.

You may appear at the public hearing to present testimony on PPL's application. Your written comments, as well as those you may present at the hearing, will be taken into consideration by the Commission when it acts on the application. Please contact us at least three days in advance of the public hearing if'you intend to present testimony at that time.

Mr. Eric Joseph Epstein August 15, 2007 Finally, please also note that earlier this year the Commission adopted new regulations concerning administrative review. Pursuant to 18 CFR Part 808.2, any person aggrieved by any action or decision of the Commission may file an administrative appeal requesting a hearing, provided such request is filed within 30 days of such action or decision. Intervention in such hearing process is also provided for in the new regulation for interested parties other than the person initiating the administrative appeal.

If you have any other questions concerning the public hearing or administrative appeals procedures before the Commission, or wish to meet with Commission staff, please do not hesitate to contact our office.
