In October 2005, Nuclear Management Company, LLC (NMC) identified that certain Technical Specifications (TS) Allowable Values for the Reactor Protection System (RPS) and Engineered Safety Features Actuation System (ESFAS) trip functions were nonconservative.

The affected values are in Table 3.3.1-1 of TS 3.3.1, "Reactor Protection System Instrumentation," and Table 3.3.2-1 of TS 3.3.2, "Engineered Safety Feature Actuation System Instrumentation," for Point Beach Nuclear Plant (PBNP), Units 1 and 2.

NMC has established administrative controls in the associated RPS and ESFAS surveillance procedures, which implemented conservative limits for the affected values. These administrative controls serve as compensatory measures pending approval of an amendment to the TS to change the allowable values.

The original schedule for submitting a proposed amendment to revise the TS was December 2006. In Reference 1, the submittal of the proposed amendment was deferred to December 17, 2007, to incorporate values from the PBNP calculation review and reconciliation project and to incorporate needed changes associated with TSTF-493, "Clarify Application of Setpoint Methodology for Limiting Safety System Settings Functions."

NMC is requesting to defer submittal of the proposed license amendment until the NRC staff review of TSTF-493 is complete and the TSTF has been issued in the Federal Resister for industry adoption as a consolidated line item improvement process (CLIIP). In the interim, NMC will continue to operate PBNP with conservative administrative limits for the affected TS Allowable Values. NMC is tracking actions associated with the nonconservative TS using the Corrective Action Process.

Document Control Desk Page 2 Summary of Commitments The following revises the commitment dates as stated in Reference 1. The proposed commitment change will allow submittal of a license amendment consistent with the NRC staff approval of TSTF-493:

NMC will submit a proposed license amendment to revise the nonconservative allowable values in TS 3.3.1 and TS 3.3.2 within 60 days of NRC noticing the availability of TSTF-493 in the Federal Register.
