DPR-24 and DPR-27 Commitment to Revise Nonconservative Technical Seecifications In October 2005, Nuclear Management Company, LLC (NMC) identified that certain Technical Specifications (TS) Allowable Values for the reactor protection system (RPS) and engineered safety features actuation system (ESFAS) trip functions were nonconservative. The affected values are in Table 3.3.1-1 of ?S 3.3.1, "RPS Instrumentation"and Table 3.3.2-1 of TS 3.3.2, "ESFAS Instrumentation", for Point Beach Nuclear Plant (PBNP), Units 1 and 2.

NMC has established administrative controls in the associated RPS and ESFAS surveillance procedures, which established conservative limits on the affected values.

These administrative controls serve as compensatory measurds pending approval of a license amendment to the TS to change the allowable values.

The original schedule for submitting a proposed amendment ta revise the TS was I

December 2006; however, as discussed with Mr. F. Lyon, the ~ R Project C Manager for PBNP during a meeting on November 2,2006, the submittal of the proposed amendment will be deferred to December 2007.

I The reasons for the deferral are:

I A calculation review and reconstitution project, which is evaluating and revising the calculations that form the basis for the conservative adminidtrative limits.

Technical Specifications Task Force document TSTF-493, Q revise Standard Technical Specifications (STS) for RPSIESFAS, is currently under NRC review. The changes in TSTF-493, which were submitted for NRC review on January 27,2006, are germane to the subject proposed amendment.

Document Control Desk Page 2 Accordingly, deferring submittal of the proposed license amendment will allow for sufficient time to incorporate the allowable values from the calculation review and reconciliation project and to incorporate needed changes associated with TSTF-493. In the interim , NMC will continue to operate PBNP with conservative administrative limits for the affected TS Allowable Values . NMC is tracking actions associated with the nonconservative TS using the Corrective Action Process.

Summary of Commitments

1. NMC will submit a proposed license amendment to revise the nonconservative allowable values in TS 3.3.1 and TS 3.3.2 by December 17, 2007.
