LRA statement Section 50.34(a)(1) is not applicable to VYNPS as it concerns applicants for a construction permit who apply on or after January 10, 1997.

Discussion: This statement was unclear to the staff. Parts of Section 50.34(a)(1) do apply to VYNPS. The part that does not is 50.34(a)(1)(ii). Based on the discussion with the applicant, the staff indicated that the statement requires clarification. Therefore, the applicant will clarify the information.
