NEW ENGLAND COALITION, INC.'S (NEC) OPPOSITION TO NRC STAFF MOTION TO STRIKE NEC RESPONSE TO NRC STAFF'S
SUMMARY
DISPOSITION ANSWER New England Coalition, Inc. (NEC) opposes the NRC Staff's motion to strike NEC's Response to the NRC Staff's Answer in Support of Entergy's Motion for Summary Disposition of New England Coalition Contention 3 (Steam Dryer) ("NEC's Response"). NEC's Response addresses facts and arguments stated in the NRC Staff's Answer in support of Entergy's motion for summary judgment, as permitted under NRC rules. The Board is to decide motions for summary judgment in this Subpart L proceeding pursuant to "the standards for summary disposition set forth in subpart G...... ". 10 C.F.R. § 2.1205(c). The subpart G summary judgment rule in turn provides that an opponent to a motion for summary judgment may respond to "any statement filed in support of the motion." 10 C.F.R. § 2.710(a).
WHEREFORE, the NRC Staff Motion to Strike should be denied.
