DOCKETED USN RC June 12,2007 (4:07pm)
RS-07-092 June 12,2007 OFFICE OF SECRETARY RULEMAKINGS AND ADJUDICATIONS STAFF Ms. Annette L. Vietti-Cook Secretary Rulemakings and Adjudications Staff U.S. Nuclear Regulatory Commission Washington, DC 20555-0001
Subject:
PRM-50-83, Comments on the Petition for Rulemaking Submitted by the Project on Government Oversight and Union of Concerned Scientists (72 Fed. Reg. 1471 3)
Reference:
Letter from Douglas J. Walters (Nuclear Energy Institute) to NRC, "PRM-50-83, Comments on the Petition for Rulemaking Submitted by the Project on Government Oversight and Union of Concerned Scientists (72 Fed. Reg. 1471 3)," dated June 12, 2007 Exelon Generation Company, LLC (Exelon) is providing comments on the petition for rulemaking on 10 CFR Part 50, submitted by the Project on Government Oversight and Union of Concerned Scientists.
Exelon endorses the comments provided by the Nuclear Energy Institute (NEI) in the referenced letter. As described in the referenced letter, the petitioners' request is redundant to actions already in progress. Further, since the responsibility for coordination between state, local, and federal entities is the responsibility of the Department of Homeland Security and is governed by Presidential directives, an amendment to 10 CFR 50 is not appropriate.
For the foregoing reasons, the subject petition for rulemaking should be denied.
Sincerely, Darin M. Benyak Director, Licensing
