TSTF-IG-05-02, Revision 1, Implementation Guidance for TSTF-423, Revision 0, Technical Specifications End States, NEDC-32988-A, dated March 2007 In Reference 1, Exelon Generation Company, LLC (EGC) requested a change to the Technical Specifications (TS) of Facility Operating License Nos. DPR-44 and DPR-56 for Peach Bottom Atomic Power Station (PBAPS), Units 2 and 3. The proposed amendment would modify TS to risk-informed requirements regarding selected Required Action End States as provided in Reference 2.
In support of the proposed change to the PBAPS TS, EGC made a regulatory commitment to follow the industry implementation guidance associated Technical Specification Task Force (TSTF)-423, Technical Specification End States, NEDC-32988-A, Revision 0 (i.e., Reference 2). Specifically, the commitment was to follow the guidance established in TSTF-IG-05-02, Implementation Guidance for TSTF-423, Revision 0, Technical Specification End States, NEDC-32988-A, Revision 0, and is documented in Enclosure 4 to Reference 1.

Nuclear Regulatory Commission Page 2 EGC has subsequently learned that the industry has revised the implementation guidance to resolve an NRC concern related to consistency between the NRC TSTF-423 model safety evaluation and the implementation guide. As a result, EGC has determined that this particular commitment will be revised to follow the guidance established in Revision 1 of the implementation guidance document (i.e., Reference 3). The revised list of regulatory commitments originally submitted in Reference 1 is provided in the enclosure to this letter.
EGC has reviewed the information supporting a finding of no significant hazards consideration that was previously provided to the NRC in Reference 1. The revised commitment provided in this submittal and the revised implementation period do not affect the bases for concluding that the proposed license amendment does not involve a significant hazards consideration.
