SUBJECT:

CULMINATION OF NRC PARTICIPATION IN THE MEMORANDUM OF AGREEMENT ON THE BIG ROCK POINT SITE

Dear Ms. Dean:

On February 13, 2006, the U.S. Nuclear Regulatory Commission (NRC) entered into a Memorandum of Agreement (MOA) with the Michigan State Historic Preservation Office (MI SHPO) and Consumers Energy (CE), the owner of the Big Rock Point (BRP) site (Enclosure 1).

Since that time, CE has completed decommissioning of the site in accordance with NRC regulations. By order dated April 6, 2007, NRC authorized the sale of the BRP site to Entergy Palisades Nuclear Company. As a result, CE is no longer a licensee of the NRC. Therefore, NRC notified the MI SHPO and CE that it is culminating its participation in the MOA (Enclosure 2). In accordance with Paragraph IV of the MOA, the NRC has incorporated into its operations manual the notification of the SHPO of any state in which NRC decommissioning activities commence.

If you have any questions on this matter, please contact me at (301) 415-6712 or jcs2@nrc.gov.

Sincerely,

/RA/

J. C. Shepherd, Project Engineer Decommissioning and Uranium Recovery Licensing Directorate Division of Waste Management and Environmental Protection Office of Federal and State Materials and Environmental Management Programs Docket No.: 50-155

Enclosures:

1. MOA
2. Letter to MI SHPO cc: Robert A. Fenech (Consumers Energy)
