ASSESSMENT FOLLOW UP LETTER - DUANE ARNOLD ENERGY CENTER

Dear Mr. Van Middlesworth:

On May 1, 2007, the NRC staff completed, as part of our quarterly review, an update of our assessment of Duane Arnold Energy Center. Our technical staff reviewed performance indicators for the most recent quarter and inspection results for the period from April 1, 2006, through March 31, 2007. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for a future inspection at your facility. This letter supplements, but does not supercede, our annual assessment letter issued on March 2, 2007.

On April 2, 2007, the NRC staff forwarded a letter concerning the final significance determination of a White inspection finding in the Emergency Preparedness (EP) cornerstone. This White finding involved the failure of the Duane Arnold Energy Center 2006 full-scale exercise critique to identify a weakness associated with a Risk Significant Planning Standard which was also a Drill and Exercise Participation performance indicator failure.

As a result of our review, we have assessed Duane Arnold Energy Center performance to be in the Regulatory Response column of the NRC's Action Matrix. Once we are notified by your staff of your readiness for the NRC to conduct a supplemental inspection to review the actions taken to address the White EP Finding, we plan to conduct supplemental inspection per procedure 95001. This inspection procedure is conducted to provide assurance that the root causes and contributing causes of risk significant performance issues are understood, the extent of condition is identified, and the corrective actions are sufficient to prevent recurrence.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
