CULMINATION OF NRC PARTICIPATION IN THE MEMORANDUM OF AGREEMENT ON THE BIG ROCK POINT SITE

Dear Mr. Conway:

By document dated February 13, 2006, the U.S. Nuclear Regulatory Commission (NRC) entered into a Memorandum of Agreement (MOA) with the Michigan State Historic Preservation Office (SHPO) and Consumers Energy (CE), the owner of the Big Rock Point (BRP) site, pursuant to 36 CFR 800.6(b)(1). Since that time, CE has completed decommissioning of the site in accordance with NRC regulations. On January 8, 2007, NRC authorized release of all the site property not part of the independent spent fuel storage installation (ISFSI) from NRC oversight. By Order dated April 6, 2007, NRC authorized the sale of the ISFSI at BRP to Entergy Palisades Nuclear Company. As a result, CE is no longer a licensee of the NRC.

Therefore, NRC is culminating its participation in the MOA. As agreed in Paragraph IV of the MOA, the NRC will continue to notify the SHPO of any state in which NRC decommissioning activities commence.
