SUBJECT:

RESPONSE TO LETTER DATED APRIL 10, 2007 - INDIAN POINT SIREN ADEQUACY

Dear Mr. Greeley:

The NRC has reviewed your letter regarding the adequacy of the new Indian Point Energy Center siren system. Specifically, you raised concerns regarding the adequacy of the volume level of the sirens used to notify the public in Rockland County. The NRC plans to take action that will address your concerns.

As you are aware, Entergy did not meet the April 15, 2007, siren system installation completion date as required by the NRCs Confirmatory Order and on April 13, 2007, had requested a second extension. The NRC denied that request, and on April 23, 2007, the NRC took action under the NRCs Enforcement Policy by issuing Entergy a Severity Level III violation with a

$130,000 civil penalty. In that enforcement action, NRC requested that Entergy include details regarding: (1) siren volume test plans; (2) test plans to demonstrate system functionality and reliability; and, (3) training plans and procedure enhancements to ensure, with a high reliability, that the sirens can be successfully activated from the counties. The NRC plans to review Entergys plan and discuss the contents of the plan with Entergy at a meeting open to public observation, in the vicinity of the site. The NRC will provide oversight of Entergys actions and will routinely provide updates on Entergys progress in resolving these important issues.

The existing siren system, which was successfully tested in March, is capable of alerting the public of an event at Indian Point. NRC Region I will continue enhanced oversight of the existing system while the new siren system is completed. Therefore, the NRC believes that, at this time, there continues to be reasonable assurance that adequate protective measures can and will be taken in the event of a radiological emergency, while Entergy works to demonstrate functionality of the new siren system.
