ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White significance determination process finding will be issued on or around April 2, 2007, to Florida Power and Light Duane Arnold, LLC as a result of inspections at the Duane Arnold Energy Center. This White finding, an issue of low to moderate safety significance which may require additional U.S.
Nuclear Regulatory Commission inspection, involved the failure of the Duane Arnold 2006 full-scale exercise critique to identify a weakness associated with a Risk Significant Planning Standard which was also a Drill and Exercise Participation (DEP) Performance Indicator (PI) failure. Specifically, the NRC concluded that during the October 18, 2006, Duane Arnold exercise there was a performance weakness associated with the licensees failure to recognize an emergency action level entry condition which led to a delay in emergency classification once conditions for a Site Area Emergency were met.
A Notice of Violation is included based on a violation of emergency preparedness planning standard 10 CFR 50.47(b)(14) and associated risk significant planning standard 10 CFR 50.54(b)(4)
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
