Please note that the US Department of Homeland Security (DHS), Office of Inspector General, Office of Investigations, acknowledged receipt of Mr.

Epstein's Motions "Re: SpeCial Needs's Emergency Planning As A Condition For A License." The correspondence from the DHS was dated, January 30, 007, but arrived via United States Postal Service on February 26, 2007. This notification is directly related to Mr. Epstein's Contention 5 in the above-captioned proceeding:

The NRC can not extend the license of a nuclear power plant that is in violation of the following Federal Regulations: 10 CFR § 50.47; and 10 CFR § 50.54; 10 CFR § Part 50 Appendix E; and 44 CFR § 350.

The Office of Inspector General's complaint # is 0704087, and was signed by Acting Chief of Investigative Support, K. A. Jordan.

As noted in Mr. Epstein Petition to Intervene, the Pennsylvania Attorney General Thomas Corbett, Esquire, docketed and forwarded the case to the Department of Homeland Security on November 20, 2006. (Epstein, Petition

On December 28,2006 and January 10, 2007, Congressman Tim Holden notified Mr. Epstein that he was pursuing the "status of the case" with the DHS and the Nuclear Regulatory Commission. (Reply Brief, February 5, 2007)
