Dear Mr. Vanderhoef:

I am writing in response to your February 15, 2007 letter to Samuel Collins, Nuclear Regulatory Commission (NRC) Region 1 Administrator. In your letter, you requested the NRC mandate a more in-depth inspection and maintenance program for the secondary cooling systems at the Indian Point nuclear power plants. Your letter also provided specific maintenance recommendations and requested NRC consider and implement those recommendations as quickly as possible due to the February 5, 2007 Unusual Event at Indian Point Unit 3.

During a telephone conversation with you on March 2, 2007, we discussed the requested actions in your letter, the ongoing NRC inspection activities related to the Unusual Event, and the formal process for petitioning NRC action in accordance with the Title 10 Code of Federal Regulations Part 2.206 (10 CFR 2.206). As discussed, we will document our inspection activities, significant findings, and licensee corrective actions in the next Indian Point Unit 3 quarterly inspection report and provide a copy to you. As you requested, we will not treat your letter as a petition for NRC action in accordance with 10 CFR 2.206.
