Dear Mr. Becker:
I am responding to your December 28, 2006, letter requesting a waiver for fees associated with the NRCs review of the Diablo Canyon Power Plant (DCPP) license amendment request. Your waiver request is based on your proposal that DCPP be considered a pilot plant for the Pressurized Water Reactor Owners Group Risk-Informed Initiative 5b. As explained below, while I am unable to grant a fee waiver under the specific regulations your letter cited, I am granting the fee waiver in accordance with the applicable provisions of 10 CFR 170.11(b)(1).
You requested an exemption under 10 CFR 170.11(a)(1)(ii) and 170.11(a)(1)(iii), which address fee exemptions for special projects. Our regulations state that a special project refers to a request for review for which fees are not otherwise specified in this chapter. Since licensing fees (e.g., fees for license amendment reviews) are specified in our regulations, I am unable to grant you the fee exemption under that part of our regulations. However, the Commission may,
... grant such exemptions from the requirements of this part as it determines are authorized by law and are otherwise in the public interest, as stated in 10 CFR Part 170.11(b)(1).
The NRC will review the amendment request for DCPP as a pilot plant for the Risk Management Technical Specifications (RMTS) Initiative 5b, Surveillance Frequency Control Program. The staff believes that this review will support generic RMTS regulatory improvements. The review of DCCPs amendment request also supports the NRCs review and approval of the traveler, TSTF-425, RMTS Initiative 5b, which will also be reviewed under fee exemption status when resubmitted. Therefore, under the provisions of 10 CFR Part 170.11(b)(1), I am granting you a fee waiver.
