FITZPATRICK NUCLEAR POWER PLANT, LICENSE RENEWAL APPLICATION The U.S. Nuclear Regulatory Commission (NRC or the staff) and representatives of Entergy Nuclear Operations, Inc., held a telephone conference call on February 26, 2007, to discuss and clarify the staffs request for additional information (RAI) concerning the James A.

FitzPatrick Nuclear Power Plant, license renewal application. The telephone conference call was useful in clarifying the intent of the staffs RAIs. provides a listing of the participants and Enclosure 2 contains the RAI discussed with the applicant, including a brief description on the status of the item.

The applicant had an opportunity to comment on this summary.

FITZPATRICK NUCLEAR POWER PLANT LICENSE RENEWAL APPLICATION FEBRUARY 26, 2007 The U.S. Nuclear Regulatory Commission (NRC or the staff) and representatives of Entergy Nuclear Operations, Inc., (ENO) held a telephone conference call on February 26, 2007, to discuss and clarify the following request for additional information (RAI) concerning the James A. FitzPatrick Nuclear Power Plant (JAFNPP), license renewal application (LRA).

RAI For LRA Section 4.2:

As part of the staff review of the JAFNPP LRA section 4.2, Reactor Vessel Neutron Embrittlement, the staff reviewed General Electric (GE) Calculation Report, GE-NE-B1100732-01, Revision 1, Final Report, dated February 1998, Plant Fitzpatrick RPV Surveillance Materials Testing And Analysis Of 120 degree Capsule At 13.4 EFPY. The staff has questions regarding the GE Report and thus the teleconference phone call on Februry 26, 2007, was conducted.

The LRA starts with the 32 effective full-power year fluence value from GE Report GE-NE-B1100732-01. The 32 Effective Full-Power Year fluence is based on measured fluence from the JAFNPP surveillance flux wires and accounts for 5% power uprate after December 1996.

The GE analysis stated that it met the intent of Draft Regulatory Guide DG-1053. This is the fluence value on which the 32-EFPY pressure-temperature (P-T) curves in the Technical Specifications are based. The LRA then straight-line extrapolates that value to 54-EFPY and uses the extrapolated fluence to evaluate CVUSE and RTNDT for the period of extended operation. The LRA stated that JAFNPP will submit additional P-T curves prior to the period of extended operation. (ref. LRA section 4.2.2) prior to the 32 EFPY at which the current curves expire.

Discussion:

During the phone call, the NRC staff stated that the staff has reviewed GE-NE-B1100732-01 and finds that the fluence calculation does not meet the requirements of Regulatory Guide (RG) 1.190. The NRC staff stated the staff will need to have the new fluence value that meets RG 1.190 to complete the review.

The staff agrees that JAFNPP has no problem meeting the requirements of 10 CFR50 for CVUSE and RTNDT; in fact the staff acknowledges this is rarely an issue for a boiling-water reator. However, the staff indicated that it is a regulatory issue that the current JAFNPP fluence value is not calculated per RG 1.190.

ENO stated that the 32-EFPY fluence on which the current P-T limits are based is a conservative projection of JAFNPP fluence. Projecting this value to 54-EFPY gives a conservative evaluation of reactor vessel embrittlement during the period of extended operation. This projection shows that JAFNPP will not have problems with vessel embrittlement during the period of extended operation.

2 JAFNPP stated that it has already committed, via Technical Specification Amendment #285, to do future fluence calculations for JAFNPP in accordance with RG 1.190. However, the next fluence calculation will not be completed prior to the completion of the draft Safety Evaluation Report (SER) for the license renewal application. JAFNPP is evaluating completion of the fluence calculation to support resolution of this issue prior to the FINAL SER for the LRA.

Based on the discussion with the applicant, the staff indicated that the staff will follow-up with an RAI regarding the subject issue that was discussed during the conference call and the applicant will response to this follow-up RAI upon its receipt.
