Secretary, U.S. NRC Washington, DC 20555-0001 OFFICE OF SECRETARY Attn: Rulemakings and Adjudications Staff RULEMAKINGS AND SECY@nrc.gov ADJUDICATIONS STAFF RE: RIN 3150-AG63 My name is Sheila Lynch-Benttinen and I am a resident of Duxbury, MA within the five mile radius of Pilgrim Nuclear Power Plant in Plymouth MA. This letter is in reference to the application to renew for twenty years the license of Pilgrim Nuclear Power Plant to operate.

I have a number of concerns:

1. The current waste is stored above ground in a pool without a "hardened" ceiling structure. The waste in the pool has a enormous half life's of radioactivity and is extremely hazardous to human health, some isotopes for scores of years, some isotopes for hundreds of years, and some isotopes for hundreds of thousands of years. To allow generation of radioactive waste for another twenty years without a permanent storage site picked or the requirement of hardening the waste in a dry cask on site is wrong. The license permit should not be allowed, but if it is allowed, it should be with a condition of hardening the current and future waste.
2. Since 9/11 our country's priorities have been to fight terrorism. Maps of U.S. nuclear power plants were found in Al Quada's hideouts in Afghanistan. Security at nuclear power plants should be increased the same way it is at airports and cargo terminals. There should be a no fly zone, and every attempt to prevent a terrorist attack, including increased security from air and water. The stakes are enormous. There should not be a permit at all, but if there is: There should not be a permit without new extra security conditions attached.
3. The evacuation plan in case of an accident is ludicrous. Can you imagine if a release happened downwind toward Cape Cod in August. Do you think every tourist on the Cape and Islands would have the slightest idea about an evacuation plan? The permit should not be allowed, but if it is allowed, the evacuation plan for an accident should include all the responsible employees of the towns of the Cape and Islands and the plan should include the population of Cape Cod in all months.
4. The Price Anderson Act allows the first 10 billion in claims against an event to be charged to a pool of money kept by the industry. 3If a coverable incident occurs, the Nuclear Regulatory Commission (NRC) is required to submit a report on the cost of it to the courts and to Congress.

If claims are likely to exceed the maximum Price-Anderson fund value, then the President is required to submit proposals to Congress. These proposals must detail the costs of the accident, recommend how funds should be raised, and detail plans for full and prompt compensation to those affected. Under the Act, the administrators of the fund have the right to further charge plants if it is needed. If Congress fails to provide for compensation, "Temp/-e = SELo(P7 SECY -o01

_edge 1 2 claims can be made under the Tucker Act (in which the government waives its sovereign immunity) for failure by the federal government to carry out its duty to compensate claimants. 2 If there were ever a major incident at Pilgrim the historical value of Plymouth and the larger regional real estate holdings, and the personal health and injury claims in the larger affected area could potentially be larger than 10 billion. The license should not be renewed, but if it is, there should be a requirement for increased safety staffing and procedures to make every effort to avoid an incident.

I personally find the generation of radioactive waste that is harmful to humanity, just for electricity generation, then to give the responsibility of safety of that waste to thousands of future generations to be morally wrong and I hope this permit is not renewed. But I am also a realist, and know that the NRC has allowed every twenty year extension to occur. If the extension occurs it is your responsibility to protect the health and welfare of this region by putting the strictest safety and health requirements attached to this permit.
