DONALD C. COOK NUCLEAR PLANT, UNITS 1 AND 2 (DCCNP-1 AND -2) -

CLOSEOUT OF LICENSEE'S RESPONSE TO GENERIC LETTER 2006-03, "POTENTIALLY NONCONFORMING HEMYC AND MT FIRE BARRIER CONFIGURATIONS" (TAC NOS. MD1570 AND MD1571)

Dear Mr. Nazar:

By letter dated June 1, 2006 (ADAMS Accession No. ML061600213), Mr. M. A. Peifer of Indiana Michigan Power (the licensee) responded to Generic Letter (GL) 2006-03, "Potentially Nonconforming Hemyc and MT Fire Barrier Configurations," for DCCNP-1 and -2. Under oath or affirmation, Mr. Peifer stated that DCCNP-1 and -2 do not rely on either the Hemyc or MT fire barrier systems. He also stated that DCCNP-1 and -2 are transitioning to the 10 CFR 50.48(c) licensing basis, and that other 1- or 3-hour fire barriers that separate redundant safe shutdown trains located within the same fire area will be reviewed and dispositioned as part of the transition to the new licensing basis.

The Nuclear Regulatory Commission (NRC) staff acknowledges receipt of your response. This letter closes out the NRC staff review of Mr. Peifers response to GL 2006-03 for DCCNP-1 and -2. If you have any questions regarding this letter, please contact me at 301-415-1451.
