NRC Office of Investigations Case No. 1-2006-004
Dear Mr. Christian:
In my previous letter to you dated December 12, 2006, I had informed you that although the NRC had completed its actions regarding Office of Investigations Case No. 1-2006-004, our files would remain open pending closure and review of an associated Department of Labor (DOL) complaint since the individual had appealed an unfavorable decision from the DOL.
Subsequent to our letter to you dated December 12, 2006, we became aware that on December 11, 2006, the DOL issued a Recommended Decision and Order Approving Settlement Agreement. The DOL found the settlement agreement between Dominion Nuclear Connecticut, Inc. and the individual to be fair and reasonable, and as a result, the complaint in this matter was dismissed with prejudice. This Recommended Decision and Order became the final order of the Secretary of Labor since an appeal was not filed with the Administrative Review Board within 10 business days. All NRC actions are now complete. We also note that the individual has withdrawn his complaint that was before the State of Connecticuts Department of Public Utility Control (DPUC).
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
