PERRY NUCLEAR POWER PLANT, UNIT 1 - WITHDRAWAL OF RELIEF REQUEST REGARDING INSERVICE INSPECTION OF REACTOR PRESSURE VESSEL-RETAINING NOZZLE-TO-VESSEL WELDS AND INNER RADII (TAC NO. MD3038)

Dear Mr. Pearce:

By letter dated September 5, 2006 (letter number PY-CEI/NRR-2983L), FirstEnergy Nuclear Operating Company (FENOC) submitted Relief Request IR-054 for Perry Nuclear Power Plant (Perry), Unit 1 from the inservice inspection requirements of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),Section XI, for reactor pressure vessel pressure-retaining nozzle-to-vessel welds and nozzle inner radii. Included in the submittal letter was acknowledgment that the approval of the request was contingent on the NRC staffs issuance of the final safety evaluation (SE) of the Electric Power Research Institute (EPRI) Technical Report 1003557, BWRVIP-108: BWR Vessel and Internals Project, Technical Basis for the Inspection Requirements for the Boiling Water Reactor Nozzle-to-Vessel Shell Welds and Nozzle Blend Radii.

Since the issuance of the NRC staffs SE for EPRI Technical Report 1003557 is not anticipated in the near future, FENOC subsequently withdrew this relief request in a letter dated November 30, 2006.

The purpose of this letter is to advise that the above cited application is being treated as withdrawn. This completes the NRC staffs review of Relief Request IR-054 submittal under TAC No. MD3038.
